Medical-Legal Issues from Jewish Law: Bibliography of Sources and Scholarship in English*

Editor’s note:

In its original form this bibliography was a selective survey of Jewish Law materials prepared in the summer of 1984 for the New York University School of Law. The expanded bibliography, containing a foreword by the Deputy President of Israel’s Supreme Court, Prof. Menachem Elon, and recently published in the USA, has been widely acclaimed by students of Jewish Law for its concise form, comprehensive nature, and clarity.

The bibliography is divided into broad sections, starting with “General Works on Jewish Law,” followed by specific legal subject categories, such as commercial law, torts, etc., familiar to lawyers and law students everywhere, and concludes with historical background sections.

The section of the bibliography reprinted here (in a different format), “Medical-Legal Issues”, specifically considers the halachic problems resulting from modern advances in medicine, science and technology. Earlier halachic authorities were not faced with questions of artificial insemination, host-mothers, cloning, genetic engineering, organ transplants, etc. and their immediate practical consequences. Today such issues, perhaps more than other aspects of Éhalacha, are generating an ever-expanding body of literature.

The section here reprinted, arranged according to authors’ names, with a detailed subject index, will be periodically updated.
