Hello,

My name is A. I'm a university student in New York. My problem is a bit complicated and I thought that maybe you could direct me to someone, probably a Rabbi, who might be able to help me.

I was born to a surrogate mother becuase my parents were not able to have children naturally due to an illness and surgery my mother had when she was younger. They used a surrogate mother's egg, with my father's sperm, and the surrogate mother gave birth to me. Immidiatly after, I was first held by my mother and father, both of them fully and halachically Jewish. I was raised completely Jewish from my first minute in the world. I studied in Jewish schools my whole life and I lived in Israel for 2 and a half years. The problem is that my surrogate mother, who I do not know, nor do I have means of contacting her, was not Jewish (as far as I know.) My parents were members of a Reform synagogue at the time and only became more observant more recently. Because of this ambiguity in my past, I consulted a Rabbi who recommended I undergo a conversion from doubt and I went to the mikveh and three shomer mitzvot men signed my teudah in August this year. I'm 21 by the way.

The problem is that I have a boyfreind I met here in New York and we are serious in our relationship and we both have become more religiosly observant during the time we have been together (a year and a half.) He is a Cohen as far as he knows. We have discussed marriage and we would like to explore the possibility further but when the question of a Cohen marrying a "convert" came up between us, a couple of Rabbis have told us that it's impossible.But am I really a "convert?" One Conservative Rabbi told me that the Conservative movement allows a Cohen to marry a convert but my boyfriend and I would feel more comfortable if this answer came from an Orthodox Rabbi, or Modern Orthodox Rabbi, or a Rabbi who would be allowed to marry us in Israel.

This problem has been a source of difficultly and tears for me because I do love him, but I don't feel comfortable asking that he choose between me or his kehuna. It is difficult for him too because we have grown to love eachother and are committed to a Jewish life and Jewish learning together, yet he feels that he is being torn between two of the most important things in his life.

I am writing to you because as a group committed to Jewish Medical Ethics, I have hope that you will be more understanding of this difficulty than other Orthodox sources I've consulted, who have dissapointed me with their insensitivity and lack of interest in listening to my story. I would appreciate it very much if you could offer me any help in this matter, or refer me to anyone who you think might be able to.

שמי א. אני סטודנטית באוניברסיטה בניו יורק. הבעייה שלי די מסובכת וחשבתי שתוכל להדריך אותי לרב שיוכל לעזור לי.

אני נולדתי לאם פונדקית כיון שאמי לא יכלה ללדת עקב מחלה וניתוח כשהייתה צעירה. השתמשו בביצית של אם פונדקית עם זרע אבי, והאם הפונדקית ילדה אותי. מייד אחרי הלידה גם אמי וגם אבי החזיקו בי, ושניהם יהודיים לכל דבר. חונכתי כיהודיה לכל דבר מהרגע הראשון אחרי הלידה. למדתי בבתי ספר יהודיים במשך כל חיי, וגרתי בארץ ישראל במשך שנתיים וחצי.

הבעייה היא שהאם הפונדקית, שאינני מכירה ואיני יכולה ליצור איתה קשר, לא היתה יהודייה עד כמה שידוע לי. הורי השתייכו לבית כנסת רפורמי באותו זמן, והפכו להיות יותר דתיים רק בזמן האחרון. עקב בעייתיות זו בעבר שלי, נתייעצתי עם רב שהמליץ על גיור מספק. הלכתי למקווה, ושלשה שומרי מצוות חתמו על התעודה שלי באוגוסט אשתקד.

אני בת 21.

הבעייה היא שיש לי חבר שהכרתי כאן בניו יורק, ויש בינינו יחס רציני. שנינו הפכנו להיות יותר דתיים במשך הזמן ששנינו מכירים זה את זה (כשנה וחצי). הוא כהן עד כמה שידוע לו. דיברנו על חתונה, ואנחנו רוצים לברר את האפשרות. אך דא עקא כשהשאלה של חיתון בין כהן וגיורת נתעוררה, היו רבנים שאמרו לנו שזה בלתי-אפשרי. האם אני באמת גיורת?

רב קונסרבטיבי אחד אמר לי שתנועתו מרשה לכהן להתחתן עם גיורת. אבל החבר שלי ואני — היינו מעדיפים לקבל תשובה כזו מרב אורתודוקסי, או רב אורתודוקסי מודרני, או רב ישראלי שיוכל לסדר לנו קידושין בארץ ישראל.

בעייה זו היא מקור קשיים ודמעות עבורי כיון שאני אוהבת אותו ואינני רוצה לבקש ממנו לבחור ביני ובין הכהונה שלו. גם לו קשה כיון שאנו נתאהבנו, ואנו מחוייבים לחיים יהודיים וללימוד התורה בצוותא. למרות זאת הוא מרגיש קרוע בין שני הדברים החשובים ביותר בחייו.

אני כותבת לכם מפני שאתם מחוייבים לאתיקה רפואית על-פי היהדות. אני תקווה שתגלו הבנה יותר עמוקה מאשר מקורות אורתודוקסיים אחרים שפניתי להם. הם איכזבו אותי בחוסר הרגישות שלהם ובחוסר הנכונות להקשיב לסיפורי האישי.

הייתי מאד שמחה אם תוכלו לעזור לי בעניין זה או להפנות אותי למי שיוכל לעשות כן.

השאלה הועברה לרב דייכובסקי, בית הדין הרבני העליון. הרב דייכובסקי דן בנושא עם הרב אלישיב. הרב אלישיב פסק שלא ניתן להתיר אלא אם כן יתברר שהגבר איננו כהן או שהוא חלל.

A: About my halacha issue. When it comes to marrying someone, I'm not anymore. so that part is less the issue. I'm still interested in what they have to say about conversion or no conversion or what. it's not urgent though since i'm not going to get married for at least a year or two…..
