Donor eggs from a married woman

שאלה:

A couple made use of a Jewish donor egg from a single woman.  They want to have another child from the same donor, but she has since married.  Is that a problem?
I am assuming that records are kept to make sure that half-siblings do not marry and that the husband of the donor would have to agree.

תשובה:

According to the opinion of Rav Mordechai Eliyahu zt"l (stated verbally), there is concern of mamzerut when using egg donations from a married woman. While most authorities disagree and maintain that the child is not a mamzer, it is recommended not to use a married donor to avoid any possible concerns regarding the child's status.
