sperm donation from a non-Jewish source

שאלה:

Dear Rabbi Halperin,

I am 40 years old single and living in Tel Aviv. I am traditional/Modern Orthodox and am thinking of having a child by myself as I have not yet met my beshert. I have already done the relevant tests and recently completed all the genetic tests. I read the article about the laws on sperm donation on the website which was interesting, insightful and useful.

I understand that at present there is no law in Israel giving the child the right to know where he/she came from or central records on sperm donation and therefore the halachic questions on unknown father identity and the chances of siblings marrying one another are still very much an issue. I have been recommended by my Maccabi fertility specialist to go to a private sperm bank to receive a non-jewish sperm donor and that the costs per try is 4 times the costs of the hospital sperm bank. Being 40 this is a serious consideration given that my chances of becoming pregnant are much lower than for the under 35s.

I wanted to know what the halachic consequences are for the child if I went through this process via the hospital sperm bank. Would the child have difficulties being married by the rabbinut even if they could prove that the person they are marrying is not a sibling (via DNA testing etc.)?

If there is emphatically no other way than taking a non-jewish sperm donor then is there a sperm bank that is considered halachically acceptable in the Tel Aviv region. I don't want to go to a private sperm bank, use a non-jewish sperm to find out that the sperm bank was not recognised and therefore my child will still have the same problems at the rabbinut.

I would really appreciate your help on this issue and may I take this opportunity to wish your family a Chag Sameach ve Kasher.

Best regards,

S
