If a Jewish couple needs a donor egg in order to have a child, and the egg donor is not Jewish, would the child be Jewish according to halakha? Would he or she need to be converted?
There is a difference of opinion on this subject among the posqim of our generation. The opinion of Rabbi Yosef Shalom Eliashiv and of Rabbi Eliezer Yehuda Valdenberg is that the woman who gives birth is the mother in all respects and, therefore, there is no need for conversion.
However, the late Rabbi Shlomo Zalman Auerbach stated that because of uncertainty (safeq), one should be strict and regard the genetic mother as the legal mother and, therefore, in his opinion the offspring of egg donation requires conversion.
Thus, it is better to be strict and convert such a child—in consultation, of course, with a qualified rav poseq.
